he received bipartisan support for the committee. both secretary of state clinton and senator john mccain praised kerry. he is expected to be confirmed by the full senate. new at 11:00, senator dianne feinstein banning a bill on semi assault rifles and ammunition clips nationwide. the bill strengthened her 1994 ban by banning the sale and manufacturing of 150 guns, including rifles and shotguns fitted for detachable magazines. the measure would not cover weapons people already own as well as hunting and sport and antique and disabled weapons. the senator says the goal is to quote, dry up the supply of the weapons over time.

>> together, we are introducing legislation to help end the mass shootings that have devastated countless families and terrorized communities. >> feinstein got in involved in gun control when supervisor harvey milk was killed by former superior dan white. and back in california, job creation and budget concerns. that is what jerry brown spoke about in the third state of the state address. this is the third time they are doing this with california in the black. we have jodi hernandez with more about the governor's address. >> reporter: good morning. governor jerry brown delivered a speech that left lawmakers smiling. the governor said california has done the impossible and now it time to make sure the state

stays on track. in his 30-minute state of the state address, governor brown laid out his ideas for the second part of the term including the water delivery system and investing in high speed rail and investing with china. he pledged to use money raised by proposition 30 wisely. that means living within our means. the governor says we will no longer spend money we do not have. >> the budget is balanced, but great risk and uncertainty lies ahead. the federal government and courts are changing the economy and could cost us billions and drive a hole in the budget. the ultimate cost of expending our health care system under the affordable care act is unknown. ignoring such evunknowns is fol. that is how we plunged into a decades of deficits.

>> reporter: the governor summed things up by saying california is back. the budget is balanced and the state is on the move. the governor's address is garnering praise from both sides of the aisle. we will have reaction tonight at 5:00 and 6:00. reporting live, jody hernandez, nbc bay area. excavating a new well today linked to the speed freak killers. this is in the same area where the well remained some of the victims of lauren herzog. several of the victims families criticized investigators for using heavy equipment saying that may have damaged the remains. the fbi is taking a careful approach on this well using a bore and camera. once they know what is there, they plan to excavate the well

by hand. it will take several days if not weeks. the highway patrol asking for witnesses to come forward and try to identify the driver who left the scene after hitting and killing a pedestrian on the freeway onramp. an elderly man was struck and killed as he crossed the 17th street ramp to 980 in oakland. three different cars hit him. one driver stopped and is helping in the investigation. the two other drivers left the scene. the chp believed the victim may have been homeless. three people have been detained after a raging fire in oakland last night. firefighters say three-story building on harrison street is an empty tinder box that is too dangerous for firefighters to enter. they believe the fire was started by squatters. police arrested three police who climbed on a nearby roof to escape.

one woman tells us seven people were living inside. no one was hurt. in san jose, police investigating the city's second homicide of the year. a woman was found shot in an apartment complex on ponselle court yesterday afternoon. officers found that woman inside one of the apartments and they are right now trying to figure out exactly what led up to the shooting. the "mercury news" says the woman was running a paper out of her apartment. it was named "anna's cigarettes." so far in the case, no afternoons. san jose police are expected to get their first look at surveillance camera video to see if a man kidnapped a girl. you can see someone on the left side of your screen presumably the 13-year-old girl walking down east st. james street. the suv blocks the struggle, but seconds later, it appears the

girl is running away. the girl always walks down the street to meet a friend to go to school. police say a man approached her on friday and dragged her into a driveway. here is the sketch of the suspect. hispanic, 25 to 30 years old and 5'10" with a medium build with black hair and brown eyes and a mustache. san francisco police hunting for a pair of armed robbers. we have video shot at a pair of family own the pharmacies in the city's russian neighborhood and one in the sunset district. both happened january 14th. the men stealing medications containing oxycodone. the men happen to look alike. both between 20 and 25 years old. both are thin and 5'9" tall.

crews are digging up a street in green bay in marin. they are trying to fix a pipeline that ruptured under the road near sir francis drake boulevard. the water was shooting six feet into the air at the rate of 1,500 gallons a minute. a dozen homes are still without water. crews are making sure the roadway is still structurally sound. >> a wet, messy morning. christina loren is here to tell us what is going on outside. rain in places? south bay. good news for marin county. the good news for everybody. back in the air quality range. today, doing much better in that department. i want to show you the live picture of san francisco. we are seeing a bit of sunshine from time to time. breaks of sun. that is the general pattern. the doppler radar tells the

okay. now to the 49ers and their quest for number six. the super bowl will be a family affair of sorts this year. 49ers head coach jim harbaugh and ravens head coach, john harbaugh will hold a news conference the friday before the big battle. >> this morning, their parents, jackie and jack and their sister had a press conference of their own. they did it on the phone. it was good fun. we have bob redell with more on this morning's harbaugh family variety show. >> reporter: a variety show with a twist. it had this reporter cringing.

risk of headache and 28% increased risk of migraine on days lightning struck within 25 miles of a person's home. experts speculate that electric tr magnetic waves may be to blame. problems into the boeing 727 dreamliner. >> they will release details about the fire that forced an emergency landing at boston's airport. the fire was caused by a battery that exploded. nobody was injured, but that and other issues prompted the faa to ground all boeing dreamliners. including all nippon flights. the san jose flights have been canceled through january 28th. still ahead, take a look. this chimpanzee is chilly.
